Hillsboro resident Noel Urias Franco, 34, was arrested for driving while intoxicated, his third or more DWI offense, Thursday after his dump truck rolled over on Ovilla Road, according to Lt. Todd Woodruff, head of the Waxahachie Police Department's criminal investigations unit.

Franco was taken to Baylor Scott & White Medical Center in Waxahachie after the single-vehicle wreck Thursday afternoon, but he wasn't booked into the Wayne McCollum Detention Center until 8:24 p.m.

Emergency crews were dispatched at about 2 p.m. to the intersection of Ovilla Road and the Interstate 35E service road, in front of Timco Logistics Systems, Inc.

"WFD and WPD personnel reported smelling alcohol on the driver’s breath, along with observing some behavioral cues that led the officers to believe he could be intoxicated," Woodruff stated via email. "He was transported by ambulance to Baylor Waxahachie, but was released. WPD officers placed him under arrest for investigation of DWI and transported him to WMDC (Wayne McCollum Detention Center). A request for a search warrant to take Franco’s blood was presented to District Judge (Cindy) Ermatinger. She signed the search warrant. We’ll be sending the blood off to DPS (Department of Public Safety) Waco for lab testing."

The driver only sustained minor injuries from the accident, said Larry Sodek, a Waxahachie Fire Department Pump Engineer also on scene.

“He could not negotiate the turn coming down the service road, over-corrected and rolled the truck,” Waxahachie Police Sgt. Rodney Guthrie said on scene. “Based off of skid marks, that what it looks like.”

Waxahachie firefighter Kevin Lindsey said the driver was out of the vehicle when first responders arrived.

The accident caused the dump truck to land on its side. During the call, the service road was shut down because of traffic.

Franco's bond is set at $3,000. The cause of the accident is still under investigation at this time, Woodruff stated.
