HUNTSVILLE, Texas (AP) A last-day appeal for a registered sex offender set to die in Huntsville has been rejected by the Texas Court of Criminal Appeals.

Thirty-nine-year-old Ramon Torres Hernandez contended in a filing Wednesday with his trial court in San Antonio that he had new evidence his appeals lawyers earlier in the appeals process were deficient.

The Court of Criminal Appeals said the claim wasn't new evidence, was improperly filed and has dismissed it.

Hernandez faced lethal injection early Wednesday evening in Huntsville for the rape and murder of a woman abducted from a San Antonio bus stop 11 years ago.
