SANTA MONICA, Calif. (AP) -A judge says he's not inclined to delay the release of "Brutal Legend," a video game starring Jack Black, but delayed a formal ruling for a week.

Los Angeles Superior Court Judge Craig Karlan said at a hearing Thursday that his tentative ruling was to deny a motion by gaming giant Activision to delay the game's October release. But he delayed giving a formal ruling until an Aug. 6 hearing because of a full court calendar and he wanted to give attorneys a chance to argue theirpositions.

Activision sued the game's developer, asking for a judge to stop the release by rival firm Electronic Arts. Activision claims it owns the game's rights, but the developer has countersued, claiming Activision only wants to protect its popular "Guitar Hero" franchise.
