BOSTON (AP) - A former Superior Court judge has been denied his request for a disability pension he said he was entitled to because of stress caused by critical newspaper articles.

Ernest Murphy claimed he suffered from post-traumatic stress disorder caused by articles written in the Boston Herald in 2002 critical of his handling of a rape case.

The Massachusetts State Retirement Board denied his claim Thursday by a 3-2 vote. He was seeking 75 percent of his $130,000 annual salary.

Murphy won a $2.1 million libel suit against the Herald in 2005, which with interest amounted to $3.4 million.

Murphy stepped down as a judge last year under an agreement with the state that said he was "permanently disabled."

Murphy's lawyer did not return a call for comment.
