A felony charge of indecency with a child filed in July against Midlothian City Council member Jason Kyle was dismissed this week in 40th District Court.

The order of dismissal, which was signed by presiding Judge Bob Carroll, was filed with the Ellis County District Clerk’s Office on March 3.

According to the order, the charge was dismissed because the evidence was insufficient for a felony conviction and an affidavit of non-prosecution was filed. The document also noted as an “other” reason, “The victim in this case gave multiple, contradictory accounts of events that took place between her and the defendant, but is now steadfast in her affidavit that the offense did not take place.”

The alleged victim, identified in court documents as “Jane Doe” due to the nature of the charge, signed a voluntary, notarized statement also placed in the file that states in part, “I made this story up and the things I told the police were not true. Nothing happened to me.”
